National Director of Public Prosecutions to Review Decision in Zizi Kodwa Case

Pretoria:The Office of the National Director of Public Prosecutions (NDPP) has announced it will review the decision made by the Director of Public Prosecutions (DPP) for South Gauteng, Adv Andrew Chauke, regarding the case involving former Minister Zizi Kodwa. This development follows a request from the Directorate for Priority Crimes Investigation (DPCI), which formally asked the NDPP to reassess the DPP’s choice to withdraw charges against Kodwa and his co-accused.
The DPP’s initial decision came after receiving representations made on behalf of the accused, prompting scrutiny over the appropriateness of that withdrawal. In accordance with Section 179 (5) (d) of the Constitution, the NDPP has the authority to review prosecutorial decisions, contingent on consultations with the relevant DPP and also taking into account representations from involved parties, including the accused, the complainant, and any other individuals deemed relevant.
The NDPP will conduct this review within the parameters of the established legal framework and will communicate the findings of this evaluation in due course. The case has drawn attention to the prosecutorial process and the mechanisms available for oversight within South Africa’s justice system.
