AUBREY NGWATLE IS CONFIDENT THAT THEY WILL DISMANTLE  MUNICIPAL STRUCTURE ACT

Pretoria: Moments of using shaded paper or flipping coin to resolve a tie of political parties with equal seats in municipal councils may be declared unlawful anytime from now. This is provided the wish of the Socialist Agenda for Dispossessed Africans (SADA) becomes a reality by the verdict of a high court.

Aubrey Ngwatle, SADA leader and councilor at Fetakgomo Tubatse Municipality in Burgersfort, Sekhukhune in Limpopo is optimistic the Pretoria High Court would decide in their favour to have Section 43(2) (c) of the Municipal Structure Act 117 of 1998 as amended be declared unconstitutional and invalid.

The Act brings about “a lot’ which is a form of gambling-like, some use shaded paper, some flip coin to arrive at a verdict. Then the lucky party gets a seat in a way resembling ‘head win, tail lose’ kind of a situation. It is called “a lot.”

Ngwatle told Timeless News: “Judge Van der Schyff reserved judgment last week and the much awaited judgment could come anytime from now. We are very optimistic this a lot would be scrapped.,”

Lawyers representing CogTA indicated they would abide by the court decision in this matter.
